This license is granted to a single natural person and may not be used by corporations, businesses, organizations, or any non-individual entity without prior written permission from the developer. This license may not be shared, transferred, or extended to any other person, household, or organization.

In the event that ownership of HermesHarpe is transferred, sold, or assigned to another party, these terms remain in full force and effect. The incoming owner assumes all obligations to existing license holders under these terms as they existed at the time of transfer.
HermesHarpe is designed for macOS 14 Sonoma and later on Apple Silicon and Intel processors. The developer makes no guarantee that the software will function correctly on future versions of macOS, on hardware configurations not listed in the system requirements, or in environments that have been modified from their default state. If a future macOS update causes the software to stop functioning, the developer is not obligated to provide a fix, update, or refund beyond the stated 30-day refund window.
HermesHarpe performs system-level monitoring functions. The developer is not responsible for conflicts, performance issues, or system instability caused by the simultaneous use of HermesHarpe alongside other security software, antivirus tools, firewalls, or system monitoring utilities. You assume full responsibility for your software environment.
HermesHarpe is provided as is, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The developer makes no representation that HermesHarpe will detect all threats, malware, unauthorized access attempts, or malicious activity on your systems. HermesHarpe is a monitoring tool and does not guarantee the security of your machines, data, or network. Use of HermesHarpe does not constitute a guarantee of protection against any security threat.
The developer is not responsible for any modified, cracked, or unauthorized versions of HermesHarpe distributed through channels other than hermesharpe.com or the official Gumroad product page. If you obtained HermesHarpe from any other source, you may be using a compromised version and the developer accepts no liability for any consequences of that use.
To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, system failure, data breaches, or security incidents, arising from your use of or inability to use HermesHarpe, even if the developer has been advised of the possibility of such damages. The developer's total cumulative liability to you for any and all claims arising from these terms or your use of HermesHarpe shall not exceed the amount you originally paid for the software.
Updates to HermesHarpe are provided at the developer's sole discretion and are not guaranteed. The developer reserves the right to modify, suspend, or discontinue the software or any feature of it at any time without notice or liability.
Your license terminates immediately and without notice if you violate any provision of these terms. Upon termination you must immediately cease all use of HermesHarpe and permanently delete all copies in your possession, including backup copies. Termination does not entitle you to a refund.
Initiating a fraudulent chargeback or payment dispute for a purchase of HermesHarpe constitutes a material breach of these terms and results in immediate termination of your license. The developer reserves the right to pursue recovery of costs associated with fraudulent chargebacks to the fullest extent permitted by law.
If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of HermesHarpe shall be resolved exclusively in the state or federal courts located in Marin County, California. You consent to the personal jurisdiction of such courts. If you are located outside the United States, you agree that California law governs these terms and that you submit to the jurisdiction of California courts for any disputes.
The developer reserves the right to modify these terms at any time. The updated terms will be posted at hermesharpe.com/legal with a new effective date. Continued use of HermesHarpe after changes are posted constitutes your acceptance of the revised terms.

This policy applies to HermesHarpe version 1.0 and all subsequent versions unless a new policy is posted. It also applies to the hermesharpe.com website.
HermesHarpe is built on a single principle: your data is yours. The developer has no interest in your data, no infrastructure to collect it, and no mechanism to access it. This is not a marketing claim — it is a technical reality.
HermesHarpe the application does not collect, store, transmit, or share any personal data of any kind. This includes but is not limited to your name, email address, IP address, device identifiers, hardware serial numbers, usage statistics, behavioral data, crash reports, diagnostics, or analytics of any kind.
The hermesharpe.com website is hosted on GitHub Pages and served through Cloudflare. These infrastructure providers may use standard technical cookies and logs for performance, security, and DDoS protection purposes. These are industry-standard infrastructure operations outside the developer's direct control. The developer does not use any cookies, tracking pixels, analytics scripts, or third-party trackers on hermesharpe.com. No personal data is collected by the developer through the website.
HermesHarpe does not require you to create an account, provide an email address, or submit any personal information to download, install, or use the software. No registration of any kind is required.
HermesHarpe does not communicate with any server, cloud service, or third party operated by or on behalf of the developer. The software performs no outbound network requests to any developer-controlled infrastructure. Ever.
HermesHarpe uses Apple's iCloud Drive exclusively to sync machine status information between your own Macs within your personal iCloud account. This data consists solely of machine health status indicators generated by your own machines. It does not contain personal information.
This iCloud data resides entirely within your personal Apple iCloud account. The developer has no access to your iCloud account or its contents under any circumstances, including legal compulsion, because the developer has no credentials, keys, or access tokens for your account. Apple's own privacy policy governs the handling of data stored in iCloud Drive.
When you uninstall HermesHarpe, iCloud Drive files created by the app may persist in your iCloud account until you manually delete them. The developer has no ability to delete these files on your behalf. Full uninstall instructions including iCloud data removal are available at hermesharpe.com/support.
All data generated by HermesHarpe including audit logs, quarantine records, threat events, and machine status files is stored locally on your Mac or within your personal iCloud account. The developer cannot access, view, modify, or delete this data at any time.
The developer does not sell, rent, trade, or otherwise transfer any user data to any third party under any circumstances. This prohibition is absolute and unconditional.
HermesHarpe does not integrate with, report to, or share data with any third-party analytics platform, advertising network, tracking service, or data broker.
The developer does not sell personal information as defined under the California Consumer Privacy Act. As no personal information is collected, there is no data to access, delete, or opt out of sharing. California residents have all rights afforded under CCPA and may exercise them, though in practice there is no personal data held by the developer to act upon.
For users in the European Economic Area, United Kingdom, and Switzerland, the developer acknowledges obligations under the General Data Protection Regulation and equivalent legislation. As HermesHarpe collects no personal data whatsoever, the developer acts neither as a data controller nor a data processor with respect to any personal information. There is no personal data to access, correct, delete, port, or restrict. EEA, UK, and Swiss users have all rights afforded under GDPR and equivalent legislation. As no data is collected, those rights are satisfied by default. If you believe the developer holds any personal data about you, you may contact the developer through hermesharpe.com to make a formal request.
HermesHarpe is not directed at children under the age of 13, or under the age of 16 where required by applicable law. The developer does not knowingly collect any information from children below these age thresholds.
If this privacy policy changes, the updated version will be posted at hermesharpe.com/legal with a new effective date. Because no data is collected, changes to this policy will never affect how previously collected data is handled, as no data has ever been collected.
Effective date: June 1, 2026
HermesHarpe comes with a full 30-day money-back guarantee from the date of purchase. No partial refunds are offered. Refunds are all or nothing.
You are eligible for a full refund if HermesHarpe fails to install or launch on a Mac that meets all of the following stated system requirements: macOS 14 Sonoma or later, Apple Silicon or Intel processor from 2019 or later, iCloud Drive enabled. For the purpose of this policy, failure to install or launch means the application cannot be opened at all on a qualifying system, displaying a system-level error or crashing immediately on launch. Dissatisfaction with specific features, detection rates, or performance does not constitute failure to install or launch.
All refund requests must include your Gumroad order number or the email address used at the time of purchase. Requests submitted without verifiable proof of purchase will not be processed.
Your license remains active while a refund request is under review. If a refund is approved and issued, your license terminates immediately upon issuance of the refund. You must cease all use of the software and delete all copies in your possession at that point.
Refund requests must be submitted through Gumroad using the refund option on your purchase receipt. Requests must be submitted within 30 days of the original purchase date as determined by the timestamp on your Gumroad receipt. If Gumroad's refund mechanism is unavailable due to a platform outage or service discontinuation, the developer will honor eligible refund requests submitted within the original 30-day window through a replacement process announced at hermesharpe.com. The developer's obligation is to process the refund, not to guarantee the availability of any specific payment platform.
Refunds will not be issued in the following circumstances:
Submitting a refund request that contains false information is a violation of these terms and results in immediate license termination. Initiating a chargeback or payment dispute with your bank or credit card provider without first requesting a refund through the official Gumroad process constitutes a material breach of these terms. The developer reserves the right to contest all chargebacks, provide evidence of purchase and delivery to payment processors, and pursue recovery of associated costs including processing fees to the fullest extent permitted by law.
All purchases are processed in US dollars through Gumroad. Refunds are issued in US dollars. The developer is not responsible for currency conversion fees, exchange rate differences, or any charges imposed by your bank or payment provider in connection with your purchase or refund. The refund amount will equal the original purchase price in US dollars.
Upon issuance of a refund your license to use HermesHarpe is immediately and permanently terminated. You must cease all use of the software and delete all copies in your possession including any backups. Continued use of HermesHarpe after a refund has been issued constitutes license infringement and a violation of these terms.
This refund policy is final. The developer reserves the right to decline any refund request that does not meet the eligibility criteria stated above. Exceptions will not be made.
